Employee Screening With a Polygraph: What Is Allowed

When goods, money or information go missing inside a company, management faces a double problem: the loss has to be investigated, and at the same time the workforce must not fall under blanket suspicion. A polygraph examination can help here — but only under conditions that many underestimate. This article sets out what German employment law permits and how to structure a check that harms nobody. The most important rule first

An employer may not order a lie detector test. Neither an employment contract nor a works agreement can validly create an obligation to take part. Only participation at the explicit, voluntary and documented request of the employee is permissible — and a refusal must carry no disadvantage whatsoever: no dismissal, no transfer, no warning, no worse appraisal.

That sounds like a restriction that makes the test worthless. In practice the opposite is true: precisely because nobody is compelled, voluntary participation carries weight. Someone who wants to clear their name is given an instrument to do it with.

How to set a check up properly

First, define the occasion and the question in writing. A specific incident, a bounded time frame, a clearly named group of people with access. Blanket testing without cause is neither proportionate nor useful.

Second, clarify the involvement of the works council where one exists. Measures affecting employee conduct are as a rule subject to co-determination, and settling that early prevents later conflict.

Third, document voluntariness. The invitation must read as an offer, not an appointment. Consent is given in writing before the start and may be withdrawn at any time.

Fourth, settle data protection. Who receives the result, how long records are kept, what happens to the charts. Those answers belong before the examination, not after it.

Fifth, ask only about the matter at hand. Questions about health, religion, party affiliation, union membership, sexual life or private affairs unrelated to the incident are off limits — regardless of any consent given.

Two typical scenarios

An acute incident. Goods are missing from the stockroom and eight people had access. What the test delivers — and what it does not

It answers whether a person is giving a truthful account of a specific matter. It replaces neither a stock count, nor access logs, nor a till audit. And it is no substitute for management: where controls are systematically absent, the next case will occur regardless of who answered the questions this time. Done properly, a check relieves pressure. The majority of employees did nothing and suffer most from the uncertainty. A transparent, voluntary procedure ends corridor rumour and suspicion faster than any internal announcement. Done badly — with pressure, surprise and unclear aims — it damages trust for a long time.
